Marc Stephens Assist with The Release of Former Harlem Kingpin Wainsworth “Unique” Hall After Serving 26 Years of a Life Sentence

On May 15, 2020, after serving 26 years of a Life sentence, former Harlem Kingpin Wainsworth Marcellus Hall, professionally known as Unique, is finally free from the federal prison system.

On June 27, 1994, a jury found Mr. Wainsworth Hall “Not Guilty” for unlawful distribution of over 330 kilograms of cocaine and money laundering over $6 million.

On the remaining counts, the prosecutor gave the wrong jury instructions, and the jury found Wainsworth "Guilty" on non-violent drug conspiracy charges. The Jury instruction error violated Wainsworth's constitutional right to a fair trial, and due process.

As a result, under the Kingpin statue, section 848, continuing criminal enterprise, Mr. Hall was sentenced to Life plus 20 years due to fabricated testimony from individuals, whom he never met before, who testified that they worked for Mr. Hall in order to reduce their sentence.

Mr. Hall admits to being involved with a drug operation, but not with the individuals who gave the fabricated testimony. The judge caught on to what was going on with the fabricated testimony, and at Mr. Hall’s sentencing told him to save himself, but Mr. Hall refused to turn into a federal informant.

Mr. Hall actions in court confirmed he would rather die in prison than to become a “snitch”.

“Send me somewhere were I could further my education so if something do work out for me in the future, at least I could go back home to my family and do the right thing”, said Wainsworth Hall at his sentencing hearing.

At the time of sentencing, Mr. Hall could not read or write. While incarcerated, Mr. Hall kept his promise to the judge, and worked extremely hard over the years committing himself to furthering his education.

Mr. Hall earned his GED in January 1998. He earned over 100 plus program rehabilitation awards, became a certified plummer, electrician, HVAC specialist, and acquired a culinary arts cooking degree, and a SurSafe license from a local college near Orlando Florida, at Coleman FCI, which means Mr. Hall is qualified to run and operate a restaurant.

Mr. Hall became a certified mentor with over 3000 plus hours of group training and participation, living with low functioning inmates preparing them to be released into society.

The Supreme Court of the United States reversed the 4th Circuit erroneous jury instructions. Wainsworth was supposed to receive a new trial, because the incorrect jury instructions during his trial in 1994 constitutes "plain error" which warrants a reversal of conviction. The 4th Circuit ruled that the error in the jury instructions was a "Harmless Error", and refused to reverse the conviction and give Wainsworth a new trial.

The Federal system does not give inmates parole. So, Mr. Hall was sentenced to die in prison for his first ever felony offense.

In March 2019, Marc Stephens prepared a Clemency Campaign, which included a video that he created titled "DEATH SENTENCE: Clemency for Wainsworth "Unique" Hall".  The video detailed Mr. Hall’s life and legal issues with the court.  The video was reposted by other YouTuber's and it went viral in a few hours gaining over 50,000 views, and generated over 3,100 signatures on Change.org.

Lawyer Brittany Barnett, was moved by Wainsworth's clemency video. Barnett works with Kim Kardashian, and the buried alive project, which Barnett co-founded with Sharanda Jones and Corey Jacobs. Barnett came to national attention when she and her co-counsel, MiAngel Cody, litigated the release of 17 people in 90 days.

Barnett wrote Mr. Hall’s clemency petition and submitted it to the Obama Administration. Unfortunately, the petition did not arrive in time to be reviewed by the Obama Administration.

On February 21, 2020, Mr. Hall was released from Federal prison through the First Step Act, which was signed into law by President Trump in 2018.

Although Mr. Hall was a free man from the Federal penitentiary system, he was now being detained at the Adelanto immigration facility in California.

Mr. Hall was born in Kingston, Jamaica. His mother is first cousins with Honorable Marcus Mosiah Garvey Jr. who was a Jamaican political activist, publisher, journalist, entrepreneur, and orator.

On January 15, 1972, at 8 years old, Wainsworth and his siblings migrated to the United States of America arriving in New York City.

Marc Stephens, who is not a lawyer, but is highly requested by many high profile celebrities, assisted with Mr. Hall’s release from immigration by preparing a legal brief, which was submitted to ICE agents at the Adelanto Immigration Facility, proven Mr. Hall’s citizenship within the United States.

On Friday, May 15, 2020, after 26 years of incarceration, Mr. Hall was finally free. 

Mr. Hall’s first trip was to Miami to spend time with his mother, Mary Garvey, whom he did not see in 26 years.
