Legally Remove All Of Your Student Loans From Your Credit Report and Increase Your Credit Scores
Many consumers are unaware of their rights to remove negative information from their credit reports. No matter if the information is accurate, or inaccurate, it can be disputed, and deleted, from your credit report.
If you find negative inaccurate information on your credit report, you have a right to dispute those items. If you initiate a dispute with the credit bureaus, they have 30 days to verify the disputed information with the creditors. If the 30 days lapse and the credit bureaus, or the creditor, did not verify the negative items they must delete the items from your credit report.
The Fair Credit Reporting Act (FCRA) specifically states this fact. Pursuant to FCRA § 609(c)(2)(E), Disclosures to consumers [15 U S C § 1681g(c)(2)(E)]:
“A consumer reporting agency shall provide to a consumer, with each written disclosure by the agency to the consumer under this section—a statement that a consumer reporting agency is not required to remove accurate derogatory information from the file of a consumer, unless the information is outdated under section 1681c of this title or cannot be verified”.
So, if accurate, or inaccurate, items cannot be verified, the credit bureaus must delete it from your credit report.
Many times the credit bureaus will tell consumers that they verified items, when in fact they did not. The credit bureaus simply matched the information from their computer screen, such as name and address, with the information in your dispute, and "verified" it as your debt.
You must make sure that the credit bureaus, and the creditors, verified the debt in order to have it removed. Simply ask for their method of verification in writing. If they refuse to submit their method of verification request for them to validate the debt. Validation means prove the debt by providing a copy of the written agreement and your signature.
Even when the debt has been verified, if they fail to validate the debt, it must be deleted.
